Terms of Service

1. THE AGREEMENT
These Terms of Service form part of an agreement (this/the "Agreement") between Linkuphost, ("LinkUpHost", “our”, “we”, “us”) and Customer (“user”,“your”, “you”). These Terms of Service governs provision of LinkUpHost ("LinkUpHost", “our”, “we”, “us”) services (the "service") and is effective as of the moment Customer indicates agreement at the LinkUpHost website or as of the moment Customer uses any LinkUpHost website, any email or element of the Service (whichever comes first). In addition to these Terms of Service, this Agreement consists of the following, each of which is incorporated into this agreement by this reference: LinkUpHost 's service level agreement, posted at http://www.linkuphost.com/legal/sla.html (the "SLA"); LinkUpHost 's acceptable use policy, posted at http://www. linkuphost.com/aup. html (the "AUP"); LinkUpHost 's privacy statement, posted at http://www.linkuphost.com/privacy.html (the "Privacy statement ").

2. LINKUPHOST'S OBLIGATIONS
Contingent on Linkuphost's acceptance of your Order, and subject to these Terms of Service, Linkuphost agrees to provide the Services. Linkuphost agrees to follow security procedures at least as stringent, in Linkuphost's reasonable judgment.

3. YOUR OBLIGATIONS
You agree to do each of the following:
(i) comply with applicable law and the Linkuphost Acceptable Use Policy
(ii) pay when due the fees for the Services,
(iii) use reasonable security precautions in light of your use of the Services,
(iv) cooperate with Linkuphost's reasonable investigation of outages, security problems, and any suspected breach of the Agreement,
(v) keep your billing contact and other account information up to date,
(vi) present a client personal identification for verification purposes related to the client information and the payment made details upon request by LinkUpHost,
vii) immediately notify Linkuphost of any unauthorized use of your account or any other breach of security. In the event of a dispute between us regarding the interpretation of applicable law or the AUP, Linkuphost's reasonable determination shall control.

4. ACCESS TO THE SERVICES
You may access the Services via the web site of LinkUpHost or according Linkuphost-provided instructions via e-mail. Linkuphost may modify its web site or support site, or may transition to new IP addresses at any time.

5. SERVICE LEVEL AGREEMENT
The Service Level Agreement(s) listed below are part of this Agreement for those Services you are buying from LinkUpHost: http://www.linkuphost.com/legal/sla.html

6. TERM
The initial term for each Order begins on the date we make the Services available for your use and continues for the period stated in the Order. If no period is stated in the Order, then the initial term shall be one month. Upon expiration of the initial term, the Order will automatically renew for successive renewal terms of one month each, unless and until one of us gives the other a written notice of non-renewal prior to the expiration of the initial term, or then-current renewal term, as applicable.

7. FEES
Linkuphost will charge you the fees stated in your Order. If you have made a minimum commitment in your Order, and your actual usage does not meet or exceed the minimum commitment, Linkuphost will charge you the difference between your minimum commitment and your actual usage. Unless you have made other arrangements, Linkuphost will charge you as follows: (i) for recurring fees, in advance, on or around the first day of each billing cycle, and (ii) for non-recurring fees (such as fees for initial set-up, overages, services) on or around the date incurred, or on or around the first day of the billing cycle that follows the date incurred, at Linkuphost's option; Unless otherwise is written in the Order, your billing cycle will be monthly, beginning on the date that Linkuphost first makes the Services available to you. If you are using Linkuphost's billing services, Linkuphost may at its option, either include the fees, charge backs, and other items with your recurring or non-recurring fees, as applicable, or deduct them from your remittances. Linkuphost may suspend all services (including services provided pursuant to any unrelated Order or other agreement we may have with you) if our charges to you are rejected for any reason. Linkuphost may charge interest on overdue amounts at 5% per month (or the maximum legal rate if it is less than 5%). If any amount is overdue by more than thirty (30) days, and Linkuphost brings a legal action to collect, or engages a collection agency, you must also pay Linkuphost's reasonable costs of collection, including attorney fees and court costs. All Purchases must be made in United States Dollars (USD) with credit or debit card made via PayPal. All fees are stated and will be charged in United States Dollars (USD). Accounts can be opened in United States Dollars (USD) only. Any "credit" that we may owe you, such as a credit for failure to meet a service level guaranty, will be applied to fees due from you for services, and will not be paid to you as a refund. Charges that are not disputed within five days of the date charged are conclusively deemed accurate. You must provide Linkuphost with accurate factual information to help Linkuphost determine if any tax is due with respect to the provision of the Services, and if Linkuphost is required by law to collect taxes on the provision of the Services, you must pay Linkuphost the amount of the tax that is due or provide satisfactory evidence of your exemption from the tax. All amounts payable for Services and Credits are stated exclusive of any VATunless stated otherwise. We reserve the right and shall be entitled to charge VAT and other taxes and duty as appropriate.You authorize Linkuphost to obtain a credit report at any time during the term of the Agreement. You agree that you are liable for all taxes and duty resulting from your purchase of services from us and use of our Services. Any credit that we may owe you, such as a credit for a SLA remedy, will be applied to unpaid fees for services or refunded to you, at our option.

8. REFUND POLICY
8.1. ForexVPS monthly plans include a 30 day money back guarantee refund only once per per person or entity per first order per one service. If the first order includes more than one service plan then a refund is applicable only to the smallest service plan from the first order. If the first order includes following upgrades of the service then a refund is applicable only to the initial payment. The 30 day money back guarantee does not cover semi-annually and annually plans. There are no prorated refunds. While customers may cancel service and billing at any time, refunds for manual or recurring payments made are not granted after the initial 30 day period. Accounts cancelled after the first 30 days are not eligble to a refund. Refunds are not granted if the customer bought the wrong product or subscription period. All refunds need a valid reason before its granted. Refunds are not granted because of market conditions or performance of third-party software. An eligible refund will be issued after a successful client personal identification verification related to the client information and the payment made details. Upon completion of the refund, the client's service shall immediately be terminated without a restore option. We reserve the right to refuse refunds if you are violated our Terms of Service or/and Acceptable Use Policy (AUP) or/and Privacy Policy or/and Service Level Agreement.
8.2. VPS plans with discount exclude a money back guarantee refund. VPS semi-annually and anually plans exclude a money back guarantee refund. There are no prorated refunds.
8.3. PT Windows VPS and PT Linux VPS Include a 14 day money back guarantee refund only once per customer per first order per one service. If the first order includes following upgrades of the service then a refund is applicable only to the initial payment. There are no prorated refunds. Refunds are not granted if the customer bought the wrong product or subscription period. All refunds need a valid reason before its granted. Refunds are not granted because of market conditions or performance of third-party software. While customers may cancel service and billing at any time, refunds for manual or recurring payments made are not granted after the initial 14 day period. Accounts cancelled after the first 14 days are not eligble to a refund. An eligible refund will be issued after providing a paid ProfitTrailer license invoice related to the client information and issued before/on the PT VPS order date. An eligible refund will be issued after a successful client personal identification verification related to the client information and the payment made details. Upon completion of the refund, the client's service shall immediately be terminated without a restore option. We reserve the right to refuse refunds if you are violated our Terms of Service or/and Acceptable Use Policy (AUP) or/and Privacy Policy or/and Service Level Agreement. .

9. FEE INCREASES
If you are under a month-to-month contract, then we may increase fees at any time on twenty days advance written notice. If the initial term of your Agreement is longer than one month, then we may increase your fees any time on thirty days advance written notice.

10. SUSPENSION
We may suspend your Services without liability if: (i) we reasonably believe that the Services are being used (or have been or will be used) in violation of the Agreement or the Acceptable Use Policy , (ii) we discover that you are, or are affiliated in any manner with, a person who has used similar services abusively in the past; (iii) you don't cooperate with our reasonable investigation of any suspected violation of the Agreement; (iv) we reasonably believe that your Services have been accessed or manipulated by a third party without your consent, (v) we reasonably believe that suspension of the Services is necessary to protect our network or our other customers, (vi) a payment for the Services is overdue, or (vii) suspension is required by law. We will give you reasonable advance notice of a suspension under this paragraph and a chance to cure the grounds on which the suspension are based, unless we determine, in our reasonable commercial judgment, that a suspension on shorter or contemporaneous notice is necessary to protect Linkuphost or its other customers from imminent and significant operational or security risk. If the suspension was based on your breach of your obligations under the Agreement, then we may continue to charge you the fees for the Services during the suspension, and may charge you a reasonable reinstatement fee (not to exceed one hundred USD) upon reinstatement of the Services.

11. TERMINATION FOR BREACH
We may terminate the Agreement without notice to you and without providing any refund if any of the following occurs: (i) we discover that the information you provided to us about yourself or your proposed use of the Services was materially inaccurate or incomplete, (ii) if you are an individual, you were not at least 18 years old or otherwise did not have the legal capacity to enter into the Agreement at the time you submitted the Order for Services, or if you are an entity or fiduciary, the individual submitting the Order for Services did not have the legal right or authority to enter into the Agreement on behalf of the person represented to be the customer, (iii) your payment of any invoiced amount is overdue, and you do not pay the overdue amount within three (3) days of our written notice, (iv) you use your Service in violation of the AUP and fail to remedy the violation within one (1) day of our written notice, (v) you violate the AUP more than once, even if you cure each violation, or (vi) you fail to comply with any other provision of the Agreement and do not remedy the failure within five (5) days of our notice to you describing the failure. You may terminate the Agreement for breach on written notice if: (i) we materially fail to provide the Services as agreed and do not remedy that failure within five (5) days of your written notice describing the failure, or (ii) we materially fail to meet any other obligation stated in the Agreement and do not remedy that failure within thirty (30) days of your written notice describing the failure.

12. ACCESS TO DATA
12.1 You will not have access to your data stored on the Linkuphost system during a suspension or following termination.
12.2 We backup the Linkuphost systems and virtual private servers on a periodic basis so that we are able to more quickly restore the systems in the event of a failure. These backups are made on a snap-shot basis and, therefore, capture only the information that exists on the system at the time of the backup (snap-shot). In addition, we may destroy all backups in Linkuphost's judgment. These backups may not be available to you or, if available, may not be useful to you outside of the Linkuphost systems and virtual private servers.

12.3 You agree that you will maintain at least one additional current copy of your programs and data stored on the Linkuphost systems and virtual private servers somewhere other than on the Linkuphost systems and virtual private servers.

13. UNAUTHORIZED ACCESS TO YOUR DATA OR USE OF THE SERVICES
Linkuphost is not responsible to you for unauthorized access to your data or the unauthorized use of the Services.

14. DISCLAIMERS
We do not promise that the Services will be uninterrupted, error-free, or completely secure. You acknowledge that there are risks inherent in Internet connectivity that could result in the loss of your privacy, Confidential Information, and property. The Services are provided AS IS. Any voluntary services we may perform for you at your request and without any additional charge are provided AS IS.
15. RISK DISCLAIMER FOR FOREX TRAIDING
Foreign exchange (Forex) trading carries a high level of risk and may result in substantial or complete loss of funds, or even losses in excess of your initial margin deposit. It should therefore be undertaken only with "risk capital," defined as funds that are not necessary to your survival or well-being. It is your responsibility to consider whether foreign exchange trading is suitable for your financial position and investment objectives. If you do not thoroughly understand either the risks involved in Forex trading you are hereby instructed not to utilize foreign exchange services or software. You should be aware of all the risks associated with foreign exchange trading, and seek advice from an independent financial advisor if you have any doubts. LinkUpHost will not be held legally responsible for any loss or damage resulting from foreign exchange trading activities or software running on LinkUpHost ForexVPS service provided to you by LinkUpHost.

16. EXPORT MATTERS
You represent and warrant that you are not a person to whom Linkuphost is legally prohibited to provide the Services.

17. CONFIDENTIAL INFORMATION
Each of us agrees not to use the other's Confidential Information except in connection with the performance or use of the Services, as applicable, the exercise of our respective legal rights under the Agreement, or as may be required by law. Each of us agrees not to disclose the other's Confidential Information to any third person except as follows:
- to our respective service providers, agents, and representatives, provided that such service providers, agents, or representatives agree to confidentiality measures that are at least as stringent as those stated in these Terms and Conditions;
- to law enforcement or government agency if required by a subpoena or other compulsory legal process, or if either of us believes, in good faith, that the other's conduct may violate applicable criminal law as required by law;
- in response to a subpoena or other compulsory legal process, provided that each of us agrees to give the other written notice of at least three days prior to disclosing Confidential Information under this subsection, unless the law forbids such notice.

18. LIMITATION ON DAMAGES.
Our obligations to you are defined by this Agreement. We are not liable to you for failing to provide the Services unless the failure results from our negligence.

19. INDEMNIFICATION
If we, our affiliates, or any of our or their respective employees, agents, or suppliers (the "Linkuphost Indemnitees") are faced with a legal claim by a third party arising out of your actual or alleged gross negligence, willful misconduct, violation of law, failure to meet the security obligations required by the Agreement, violation of the AUP, then you will pay the cost of defending the claim (including reasonable attorney fees) and any damages award, fine, or other amount that is imposed on the Linkuphost Indemnitees as a result of the claim. Your obligations under this subsection include claims arising out of the acts or omissions of your employees, any other person to whom you have given access to the Services, and any person who gains access to the Services as a result of your failure to use reasonable security precautions, even if the acts or omissions of such persons were not authorized by you. We will choose legal counsel to defend the claim. You must comply with our reasonable requests for assistance and cooperation in the defense of the claim.

20. WHO MAY USE THE SERVICE
You cannot resell the Services, but you are responsible for use of the Services by any third party to the same extent as if you were using the Services yourself. Unless otherwise agreed, Linkuphost will provide support only to you, not to any other person you authorize to use the Services. There are no third party beneficiaries to the Agreement, meaning that third parties do not have any rights against either of us under the Agreement.

21. CHANGES TO THE ACCEPTABLE USE POLICY
We may change our Acceptable Use Policy, Service Level Agreement or Terms of Service. Any such changes made during the term of your Agreement will become effective to your account upon the first to occur of: (i) renewal, (ii) your execution of a new/additional Order for your account that incorporates the revised AUP or Terms of Service, or (iii) two (2) days following our notice to you describing the change. If the change materially and adversely affects you, you may terminate the Agreement upon the first renewal following the date the change became effective for your account. If you terminate your Service because the change adversely affects you, we may decide not to enforce that change with respect to your account and keep your Agreement in place for the remainder of the term.

22. NOTICES
Your routine communications regarding the Services should be sent to: notice@linkuphost.com If you want to give us a notice, you should send it by electronic mail to: notice@linkuphost.com. Linkuphost's routine communications regarding the Services and legal notices will be sent to your account and e-mail address by electronic mail. Linkuphost may give notice of an amendment to the AUP or these Terms of Service by posting the notice on your accout at the support site of LinkUpHost or to your e-mail address by electronic mail. Notices are deemed received as of the time delivered. Notices must be given in the English language.

23. IP ADDRESSES
Upon expiration or termination of the Agreement, you must discontinue use of the Services and relinquish use of the IP addresses and server names assigned to you by Linkuphost in connection with Services. You agree that Linkuphost may, as it determines necessary, change the IP addresses assigned to you by Linkuphost in connection with Services. You agree that Linkuphost may, as it determines necessary, make modifications to DNS records and zones on Linkuphost managed or operated DNS servers and services.

24. ASSIGNMENT/SUBCONTRACTORS
You may not assign the Agreement without Linkuphost's prior written consent. We may assign the Agreement in whole or in part as part of a corporate reorganization or a sale of our business, and we may transfer your Confidential Information as part of any such transaction. Linkuphost may use third party service providers to perform all or any part of the Services, but Linkuphost remains responsible to you under this Agreement for work performed by its third party service providers to the same extent as if Linkuphost performed the Services itself.

25. FORCE MAJEURE
Neither of us will be in violation of the Agreement if the failure to perform the obligation is due to an event beyond our control, such as significant failure of a part of the power grid, significant failure of the Internet, natural disaster, war, riot, insurrection, epidemic, strikes or other organized labor action, terrorism, or other events of a magnitude or type for which precautions are not generally taken in the industry.

26. GOVERNING LAW, LAWSUITS
The Agreement is governed by the laws of the Republic of Bulgaria. The Agreement shall not be governed by the United Nations Convention on the International Sale of Goods. Exclusive venue for all disputes arising out of the Agreement shall be in the courts in Sofia, the Republic of Bulgaria, and we each agree not to bring an action in any other city, country or state. You waive all objections to this venue and agree not to dispute personal jurisdiction or venue in these courts. You agree that you will not bring or participate in any class action lawsuit against Linkuphost or any of its employees or affiliates. Each of us agrees that we will not bring a claim under the Agreement more than one month after the time that the claim accrued.

Service Level Agreement (SLA)

This Service Level Agreement form part of an agreement (this/the "Agreement") between Linkuphost, ("LinkUpHost", “our”, “we”, “us”) and Customer (“user”,“your”, “you”). This Service Level Agreement governs provision of LinkUpHost ("LinkUpHost", “our”, “we”, “us”) services (the "service") and is effective as of the moment Customer indicates agreement at the LinkUpHost website or as of the moment Customer uses any LinkUpHost website, any email or element of the Service (whichever comes first). In addition to this Service Level Agreement, this Agreement consists of the following, each of which is incorporated into this agreement by this reference: LinkUpHost 's terms of service, posted at http://www.linkuphost.com/tos.html (the "Terms of Service"); LinkUpHost 's acceptable use policy, posted at http://www.linkuphost.com/aup.html (the "AUP"); LinkUpHost 's privacy statement, posted at http://www.linkuphost.com/privacy.html (the "Privacy statement").

Data Center Network
We guaranty that our data center network will be available 99.95% of the time in any given billing period, excluding scheduled maintenance.

Data Center Infrastructure
We guaranty that the data center Heating, Ventilating and Air Conditioning (HVAC) system and power will be functioning 99.95% of the time in any given billing period, excluding scheduled maintenance. Infrastructure downtime exists when servers downtime occurs as a result of power or heat problems.

Server Hosts
We guaranty the functioning of all server hosts including compute, storage, and hypervisor. If a cloud server host fails, we guaranty that restoration or repair will be complete within twelve hours of problem identification. This guarantee covers the hardware and virtualisation hypervisor layers only and not the software (including but not limited to operating systems and applications) running within servers.

Hosts migration and scheduled maintenance
If a server migration or scheduled maintenance is required, we will notify you at least 24 hours in advance of beginning the migration or scheduled maintenance, unless we determine in our reasonable judgment, that we must begin the migration sooner to protect your cloud server data or service.

Credits
If we fail to meet a guaranty stated, you will be eligible for a credit. Credits will be calculated as a percentage of the fees for the LinkUpHost’s services adversely affected by the failure for the current billing period during which the failure occurred (to be applied at the end of the billing cycle to your billing account), as follows:
- Data Center Network: Five percent (5%) of the fees for each additional hour of data center network downtime, up to 100% of the fees on monthly tax basis. The additional hours are measured after initial 0.1% time on the current billing period basis and from the time at which you validly inform us at support@linkuphost.com;
- Data Center Infrastructure: Five percent (5%) of fees for each additional hour of infrastructure downtime, up to 100% of the fees on monthly tax basis. The additional hours are measured after initial 0.1% time on the current billing period basis and from the time at which you validly inform us at support@linkuphost.com;
- Server Hosts: Five percent (5%) of the fees for each additional hour of downtime, up to 100% of the fees on monthly tax basis. The additional hours are measured after initial twelve hours and from the time at which you validly inform us at support@linkuphost.com;
- Hosts migration and scheduled maintenance :Five percent (5%) of the fees for each additional hour of downtime, up to 100% of the fees on monthly tax basis. The additional hours are measured after initial 24 hours and from the time at which you validly inform us at support@linkuphost.com.

Definitions: for purposes of this Service Level Guaranty:
"server" means your unique virtual machine instance, colocated server or dedicated server;
" server fees" means the fees for your LinkUpHost services for the monthly billing period in which the failure occurred;
"server host" means the physical server which hosts your unique virtual machine instance;
"data center network" means the portion of The LinkUpHost network extending from the network egress point of your cloud server host to the outbound port of the data center border router;
"power" includes UPSs, PDUs and cabling, but does not include the power supplies in cloud server hosts;
"scheduled maintenance" means maintenance that is announced at least 24 hours in advance.

Limitations
You are not entitled to a credit if you are in breach of your services agreement with the LinkUpHost services (including your payment obligations to us) until you have cured the breach. You are not entitled to a credit if downtime would not have occurred but for your breach of your agreement with the LinkUpHost services or your misuse of the LinkUpHost services, servers and systems. You are not entitled to a credit if you are in breach of the Acceptable Use Policy (AUP). You are not entitled to refund of money. You are entitled to a credit in your billing LinkUpHost account.
The following items or situations are exempt from LinkUpHost’s guarantees:
- acts or omissions of you or your users;
- scheduled maintenance which we have announced at least 24 hours in advance;
- factors outside our control, including but not limited to any force majeure events;
- failures, acts or omissions of our upstream providers or failures of the internet;
- software running within your cloud servers;
- actions of third parties, including but not limited to security compromises, denial of service attacks and viruses provided LinkUpHost makes reasonable efforts to keep its software and systems up to date;
- violations of our Acceptable Use Policy (AUP);
- law enforcement activity.
To receive a credit, you must contact your LinkUpHost support team at support@linkuphost.com within five (5) days following the end of the downtime. You must show that your use of the LinkUpHost services was adversely affected in some way as a result of the downtime to be eligible for the credit.
This Service Level Guaranty is your sole and exclusive remedy for the LinkUpHost services unavailability. Notwithstanding anything in this Service Level Guaranty to the contrary, the maximum total credit for the current billing period, including all guaranties, shall not exceed 100% of your fee on monthly basis. Credits that would be available but for this limitation will not be carried forward to future billing periods. This Service Level Guaranty is part of your Agreement with LinkUpHost, along with LinkUpHost Terms of Service and Acceptable Use Policy (AUP), and is subject to the terms and conditions stated in those documents.

Acceptable Use Policy (AUP)

This Acceptable Use Policy form part of an agreement (this/the "Agreement") between Linkuphost, ("LinkUpHost", “our”, “we”, “us”) and Customer (“user”,“your”, “you”). This Acceptable Use Policy governs provision of LinkUpHost ("LinkUpHost", “our”, “we”, “us”) services (the "service") and is effective as of the moment Customer indicates agreement at the LinkUpHost website or as of the moment Customer uses any LinkUpHost website, any email or element of the Service (whichever comes first).
In addition to this Acceptable Use Policy, this Agreement consists of the following, each of which is incorporated into this agreement by this reference: LinkUpHost 's service level agreement, posted at http://www.linkuphost.com/legal/sla.html (the "SLA"); LinkUpHost 's terms of service, posted at http://www. linkuphost.com/tos.html (the "Terms of Service"); LinkUpHost 's privacy statement, posted at http://www.linkuphost.com/privacy.html (the "Privacy statement"). This AUP is incorporated by reference in your hosting services agreement with LinkUpHost.
Your services may be suspended or terminated for violation of this AUP in accordance with your hosting services agreement with LinkUpHost.
Capitalized terms used in this AUP shall have the meaning given in your hosting services agreement.

1. Abuse
You may not use LinkUpHost's network or services to engage in, foster, or promote illegal, abusive, or irresponsible behavior, including:
- Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network;
- Monitoring data or traffic on any network or system without the express authorization of the owner of the system or network;
- Interference with service to any user of the LinkUpHost or other network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks;
- Use of an Internet account or computer without the owner's authorization;
- Collecting or using email addresses, screen names or other identifiers without the consent of the person identified (including, without limitation, phishing, Internet scamming, password robbery, spidering, and harvesting);
- Collecting or using information without the consent of the owner of the information;
- Use of any false, misleading, or deceptive TCP-IP packet header information in an email or a newsgroup posting;
- Use of the service to distribute software that covertly gathers information about a user or covertly transmits information about the user;
- Use of the service for distribution of advertisement delivery software unless: (i) the user affirmatively consents to the download and installation of such software based on a clear and conspicuous notice of the nature of the software, and (ii) the software is easily removable by use of standard tools for such purpose included on major operating systems; (such as Microsoft's "ad/remove" tool); or
- Any conduct that is likely to result in retaliation against the LinkUpHost network or website, or LinkUpHost’s employees, officers or other agents, including engaging in behavior that results in any server being the target of a denial of service attack (DoS).

2. Bulk Email
You may not use a LinkUpHost Virtual Private Server or Mail Service to send bulk mail. You may use LinkUpHost dedicated hosted server to send bulk mail, subject to the restrictions in this Acceptable Use Policy.

3. Mail Requirements
You must comply with the CAN-SPAM Act of 2003 and other laws and regulations applicable to bulk or commercial email. In addition, your bulk and commercial email must meet the following requirements:
- Your intended recipients have given their consent to receive email from you via some affirmative means, such as an opt-in procedure;
- Your procedures for seeking consent include reasonable means to ensure that the person giving consent is the owner of the email address for which consent is given;
- You retain evidence of each recipient's consent in a form that can be promptly produced on request, and you honor recipient's and LinkUpHost's requests to produce consent evidence within 24 hours of receipt of the request;
- You have procedures in place that allow a recipient to revoke their consent - such as a link in the body of the email, or instructions to reply with the word "Remove" in the subject line; you honor revocations of consent within 24 hours, and you notify recipients that the revocation of their consent will be implemented in 24 hours;
- You must post an email address for complaints (such as abuse@yourdoman.com) in a conspicuous place on any website associated with the email, you must register that address at abuse.net, and you must promptly respond to messages sent to that address;
- You must have a Privacy Policy posted for each domain associated with the mailing;
- You have the means to track anonymous complaints;
- You may not obscure the source of your email in any manner, such as omitting, forging, or misrepresenting message headers or return addresses. Your email must include the recipients email address in the body of the message or in the "TO" line of the email;
- The subject line of the email must clearly describe the subject matter contained in the email, and the message must include valid contact information; and
- You must not attempt to send any message to an email address if 3 consecutive delivery rejections have occurred and the time between the third rejection and the first rejection is longer than fifteen days. These policies apply to messages sent using your LinkUpHost services, or to messages sent from any network by you or any person on your behalf that directly or indirectly refer the recipient to a site or an email address hosted via your LinkUpHost service. In addition, you may not use a third party email service that does not practice similar procedures for all its customers. These requirements apply to distribution lists prepared by third parties to the same extent as if the list were created by you. LinkUpHost may test and otherwise monitor your compliance with its requirements. LinkUpHost may block the transmission of email that violates these provisions. LinkUpHost may, at its discretion, require certain customers to seek advance approval for bulk and commercial email, which approval will not be granted unless the customer can demonstrate that all of the requirements stated above will be met.

4. Unsolicited Communications
You may not use your service to send email or any other communications to a person who has indicated that they do not wish to receive it. If the communication is bulk mail, then you will not be in violation of this section if you comply with the 24 hours removal requirement described above.

5. Vulnerability Testing
You may not attempt to probe, scan, penetrate or test the vulnerability of a LinkUpHost system or network, or to breach LinkUpHost's security or authentication measures, whether by passive or intrusive techniques, without LinkUpHost's express written consent.

6. Newsgroup, Chat Forums, Other Networks
You must comply with the rules and conventions for postings to any bulletin board, chat group or other forum in which you participate, such as IRC and USENET groups including their rules for content and commercial postings. These groups usually prohibit the posting of off-topic commercial messages, or mass postings to multiple forums. You must comply with the rules of any other network you access or participate in using your LinkUpHost services.

7. Offensive Content
You may not publish, transmit or store on or via LinkUpHost's network and equipment any content or links to any content that LinkUpHost reasonably believes:
- constitutes, depicts, fosters, promotes or relates in any manner to child pornography, bestiality, or non-consensual sex acts;
- is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech;
- is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
- is defamatory or violates a person's privacy;
- creates a risk to a person's safety or health, creates a risk to public safety or health, compromises national security, or interferes with a investigation by law enforcement;
- improperly exposes trade secrets or other confidential or proprietary information of another person;
- is intended to assist others in defeating technical copyright protections;
- infringes on another person's copyright, trade or service mark, patent, or other property right;
- promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking;
- is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to LinkUpHost;
or
- is otherwise malicious, fraudulent, or may result in retaliation against LinkUpHost by offended viewers or recipients, or is intended to harass or threaten. Content "published or transmitted" via LinkUpHost's network or equipment includes Web content, email, bulletin board postings, chat, tweets, and any other type of posting or transmission that relies on the Internet.

8. Live Events
You may not use your LinkUpHost services to stream live sex acts of any kind, even if the content would otherwise comply with the AUP. LinkUpHost may prohibit you from streaming other live events where there is a special risk, in LinkUpHost’s reasonable discretion, that the event may violate the Offensive Content section above.>

9. Streaming
You may not use your LinkUpHost services to stream any video or audio. You agree that these services degrade the quality of service to all subscribers and LinkUpHost may immediately and without notice terminate any service which has been identified as audio or video streaming.

10. Copyrighted Material
You may not use LinkUpHost's network or services to download, publish, distribute, or otherwise copy or use in any manner any text, music, software, art, image, or other work protected by copyright law unless:
- you have been expressly authorized by the owner of the copyright for the work to copy the work in that manner; or
- you are otherwise permitted by established copyright law to copy the work in that manner. It is LinkUpHost's policy to terminate in appropriate circumstances the services of customers who are repeat infringers.

11. Shared Systems
You may not use any shared system provided by LinkUpHost in a way that unnecessarily interferes with the normal operation of the shared system, or that consumes a disproportionate share of the resources of the system. For example, we may prohibit the automated or scripted use of LinkUpHost Services if it has a negative impact on the systems and services, or we may require you to repair coding abnormalities in the code if it unnecessarily conflicts with other customers’ use of the hosting systems and services. You agree that we may quarantine or delete any data stored on a shared system or servers if the data is infected with a virus, or is otherwise corrupted, and has the potential to infect or corrupt the system or other customers' data.

12. ForexVPS
You must use your LinkUpHost ForexVPS only for Forex related activities. You may not use your LinkUpHost ForexVPS for any non-Forex activities. You may not install on your LinkUpHost ForexVPS any server services as Database Server (an example Oracle Database or Microsoft SQL Server), VPN, E-mail, Web or other kind of server service. You may not install on your LinkUpHost ForexVPS any software not related to Forex activities. You may not use your LinkUpHost ForexVPS as backup storage or non-Forex data storage. You may not install on your LinkUpHost ForexVPS Microsoft Office suite or Microsoft Office applications.

13. Cloud VPS
You must use your LinkUpHost Cloud VPS only for related activities according your Cloud VPS plan.

14.Prohibited software
You may not operate any file sharing, mass mail or IRC (Internet Relay Chat) software in any LinkUpHost service. This includes, but is not limited to uTorrent, bitTorrent, eMule, Limewire, mIRC. You may not use Blockchain VPS or other virtual hardware based services for cryptocurrency mining activities. You agree that these services degrade the quality of service to all subscribers and LinkUpHost may immediately and without notice terminate any service which has been identified in violation of the Acceptable Use Policy (AUP).

15. Accounts
You will be provided with your account for your personal usage and access to your LinkUpHost service and you must use only this account. You may change only the password of your account provided by LinkUpHost for your personal usage. You may not change the built-in administrator account or root account on your LinkUpHost service. You may not change password of any accounts on LinkUpHost’s services and servers different from your account provided by LinkUpHost for your personal usage. You may not use or change any accounts on your LinkUpHost service or other LinkUpHost’s services and servers different from your account provided by LinkUpHost for your personal usage. You may not create other account on your LinkUpHost service or other LinkUpHost’s services and servers. You may not use your LinkUpHost Cloud VPS as backup storage except when you use LinkUpHost Cloud VPS Backup custom plan.

16. Other
You must have valid and current information on file with your domain name registrar for any domain hosted on the LinkUpHost network. You may only use IP addresses assigned to you by LinkUpHost in connection with your LinkUpHost services. You agree that if the LinkUpHost IP numbers assigned to your account are listed on an abuse database like Spamhaus, you will be in violation of this AUP, and LinkUpHost may take reasonable action to protect its IP numbers, including suspension and/or termination of your service, regardless of whether the IP numbers were listed as a result of your actions. You agree that if you register a DNS record or zone on LinkUpHost managed or operated DNS servers or services for a domain of which you are not the registrant or administrative contact according to the registrars WHOIS system, that, upon request from the registrant or administrative contact according to the registrars WHOIS system, LinkUpHost may modify, transfer, or delete such records or zones.

17. SLA
No credit will be available under a LinkUpHost service level guaranty or agreement for interruptions of service resulting from AUP violations.

Job Responsibilties:

  • Part of one of the four existing shift structures that is responsible for monitoring and repairing the LinkUpHost's Datacenter network network and services.
